nuni terms of service

these terms of service ("terms") govern your access to and use of nuniwellness.com (the "site") and any products purchased through it. the site is operated by 9573-6690 québec inc., doing business as "nuni" ("nuni," "we," "us," or "our"), a corporation existing under the laws of québec, canada.

by accessing the site, creating an account, or placing an order, you agree to these terms. if you don't agree, please don't use the site.

1. changes to these terms

we may update these terms from time to time. changes take effect once posted to this page with an updated "last updated" date. continuing to use the site after changes are posted means you accept the updated terms. if a change is material, we'll make reasonable efforts to flag it.

2. eligibility

you must be at least 18 years old, or the age of majority in your province, territory, or state, to place an order or enter into these terms. if you're under 18, a parent or guardian can purchase on your behalf. nuni products are intended for the person wearing them, regardless of who makes the purchase.

3. accounts

if you create an account, you're responsible for keeping your login information secure and for all activity under your account. let us know right away at info@nuniwellness.com if you think your account has been accessed without authorization.

4. products

nuni sells self-heating, single-use warming patches and related period comfort products. product descriptions, images, and packaging are provided for general reference and may vary slightly from what you receive.

nuni products are intended to provide gentle warmth and comfort. they are not a medical device and are not intended to diagnose, treat, cure, or prevent any disease or condition. they are not a substitute for medical advice, and you should talk to a healthcare provider about any health concerns, including period pain. always follow the usage and safety instructions included with your order.

5. orders and pricing

we reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or product availability issues. prices are listed in CAD or USD, depending on region, and may change at any time without notice, though changes won't affect orders already placed. you're responsible for any applicable taxes and duties.

6. subscriptions

some nuni products are available on a recurring subscription basis. by subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel. you can view your delivery frequency, skip, pause, or cancel your subscription at any time through your account, subject to the terms posted there at checkout. subscription orders that have already been processed or shipped cannot be canceled or refunded except as described in our return policy.

7. shipping

we currently ship to canada and the united states. shipping timelines, carriers, and costs are provided at checkout and may vary. nuni isn't responsible for delays caused by carriers, customs, or events outside our control.

8. returns and refunds

returns and refunds are handled under our return & refund policy, which is incorporated into these terms by reference. please review it before requesting a return.

9. intellectual property

all content on the site, including text, graphics, logos, product designs, and the nuni name and branding, is owned by or licensed to nuni and protected by copyright, trademark, and other intellectual property laws. you may not copy, reproduce, distribute, or create derivative works from any part of the site or its content without our written permission.

10. user content

if you submit reviews, photos, comments, or other content to us (including through social media, email, or the site), you grant nuni a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and business purposes. you're responsible for making sure anything you submit is accurate and doesn't infringe on anyone else's rights.

we may remove any user content at our discretion, including content that's false, offensive, or violates these terms.

11. prohibited use

you agree not to:

• use the site for any unlawful purpose
• attempt to gain unauthorized access to the site, other accounts, or our systems
• interfere with the site's operation, including through malware, scraping, or automated bots
• resell nuni products without our written authorization
• submit false, misleading, or fraudulent information, including for orders or reviews

12. third-party links

the site may link to third-party websites or services we don't control. we're not responsible for the content, policies, or practices of any third-party site.

13. disclaimer of warranties

the site and products are provided "as is" and "as available." to the fullest extent permitted by law, nuni disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. nothing in this section limits any warranty or protection you're entitled to under applicable consumer protection law that can't be excluded by agreement.

14. limitation of liability

to the fullest extent permitted by law, nuni is not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or products. our total liability for any claim relating to the site or a product is limited to the amount you paid for the product giving rise to the claim. nothing in these terms limits liability that can't be limited under applicable law.

15. indemnification

you agree to indemnify and hold nuni, its founders, employees, and affiliates harmless from any claims, losses, or expenses arising from your breach of these terms or misuse of the site or products.

16. governing law and disputes

these terms are governed by the laws of the province of québec and the federal laws of canada applicable in québec, without regard to conflict of law principles. any dispute arising from these terms or your use of the site will be subject to the exclusive jurisdiction of the courts of the judicial district of montréal, québec, except where applicable consumer protection law gives you the right to bring a claim in your own jurisdiction.

nothing in these terms limits any right you have under québec's consumer protection act or other applicable consumer protection law, including your right to bring or participate in a class action.

17. severability

if any part of these terms is found unenforceable, the rest of the terms remain in effect.

18. entire agreement

these terms, along with our privacy policy and return policy, make up the entire agreement between you and nuni regarding the site and your orders.
